Florida Statute 826.04 makes it illegal to knowingly marry or have sexual intercourse with a close family member. These close family members are known as “people related by lineal consanguinity.” In layman’s terms, those relations include a grandparent, mother, father, brother, sister, uncle, aunt, nephew, or niece.
Violation of this statute is a felony of the third degree, punishable by up to 5 years in a Florida State Prison. “Sexual intercourse” as defined in this statute is “the penetration of the female sex organ by the male sex organ, however slight. . . ” This means you do not have to ejaculate for the State to prove sexual intercourse.
