If you have been arrested in the Orlando area for trafficking in Oxycodone or Oxycotin (referred to casually as “Oxys”) in violation of Florida Statute 893.1351(C) you will need to hire excellent representation if you want to have any chance of avoiding a mandatory jail sentence!
Trafficking charges in Florida carry mandatory minimum sentences. These are jail sentences that are mandatory by law and they must be served day for day with no “gain time” or time off for good behavior. Trafficking in Oxys carries the following minimum penalties:
- If you have between 4 and 14 grams of oxycodone, the minimum prison sentence you can serve under the law is 3 years. There is also a fine of $50,000.
- If you have between 14 and 28 grams of oxycodone, the minimum prison sentence you can serve under the law is 15 years. There is also a fine of $100,000.
- If you have between 28 grams and 30 kilograms of oxycodone, the minimum prison sentence you can serve under the law is a life sentence unless, at some point during the sale, distribution or delivery someone died. Then the crime is a capital felony punishable by death.
- If you have over 60 kilograms of oxycodone, it is a capital felony punishable by death.
This is a very serious crime! Because trafficking charges are determined by weight, just having a few pills in your pocket can mandate a prison sentence. This is true even if it is your first offense! Prosecutors in the State of Florida view oxycotin as a danger to society. They will not cut you a break. This charge can result in your spending your life in prison. Do not trust your life to an inexperienced attorney.
