- Under the law any person 18 years of age or older who intentionally lures or entices, or attempts to lure or entice, a child under the age of 12 into a structure, dwelling, or conveyance for other than a lawful purpose commits a misdemeanor of the first degree, punishable by up to one year in the county jail. The purpose does not have to be sexual. It can be for any reason not allowed by the law.
- If you have been previously convicted of luring or enticing a child, and are charged again, the penalty is increased. A second offense is a third degree felony punishable by up to five years in a state prison.
